  What is the right of a named beneficiary in the Purchase Order and can a purchaser change or revoke his/her nominated beneficiary?

Q1 : What is the right of a named beneficiary in the Purchase Order and can a purchaser change or revoke his/her nominated beneficiary?

 

A1 : The beneficiary is the person for whom the plot / cinerary urn compartment is intended for interment or for the storage of his /her ashes. The Purchaser may at any time before interment (for burial plot) or depository of cinerary urn in writing nominate the beneficiary for the plot / cinerary urn compartment and may from time to time to revoke his/her nomination and appoint any other person to be his/her beneficiary. Where no person has been nominated, the Purchaser shall be deemed the beneficiary for the plot or urn compartment.

   
 
   
 

Q2 : If Purchaser died without nominating any beneficiary and the Purchaser did not use the plot for his /her own interment nomination of beneficiary for his / her purchased Burial Plot, can the deceased Purchaser's family member request that the Company transfer the said plot under their name?

 

A2 : No. The transfer of ownership can only be perfected in accordance to the law of succession in Malaysia. (For example: vide Letter of Administration [LA] or Grant of Probate from the court)

   
 
   
 

Q3 : Can a Purchaser nominate more than one beneficiary for a Single plot?

 

A3 : No. The Purchaser can nominate only one beneficiary at a time. A prior nomination will be automatically nullified by subsequent nomination.

   
 
   
 

Q4 : What should the Purchaser do if he/she is NOT going to be in Malaysia or will not be available when the need arises for the burial plot to be used for interment?

 

A4 : The Purchaser can, before leaving the country, execute the "Appointee Nomination Form" which will give the appointee the right to nominate beneficiary at any time in absence of the Purchaser.

   
 
   
 

Q5 : After the removal of the cinerary urn deposited in the cinerary urn compartment, can the Purchaser transfer the particular vacant compartment to another person or deposit another cinerary urn in the particular compartment?

 

A5 : No. The Purchase Order clearly states that "No transfer in any manner whatsoever will be permitted after the licence herein has been exercised".

   
 
   
 

Q6 : Can foreigner to be buried at Nirvana Memorial Park?

  A6 : Yes, provided that a valid Burial Permit from the relevant authority is furnished before burial.
   
 
   
  Q7 : What is the land status of Nirvana Memorial Park, Semenyih?
  A7 : The said land is a freehold land and free from all encumbrances.
   
 
   
  Q8 : How can the Purchaser be assured of that the Pre-need FSP will be delivered to the Purchaser in the future?
  A8 : The money received from the Purchaser for the Pre-need FSP is paid into a trust account managed and maintained by BHLB Trustee Berhad, a wholly owned subsidiary of BHLB Bank Berhad. The capital sum and accumulated income from the trust fund will be utilized for the payment of goods and services when the delivery of such goods and services is called upon. This arrangement ensures independent performance of the contract.
   
 
   
 

Q9 : Can the Purchaser get a refund on the money paid for the purchase of Pre-need FSP when one day the Company decides to discontinue its business?

 

A9 : In the unlikely event of our Company discontinuing its business or ever, for that matter, entering into liquidation, the money in the trust account will be utilized by our trustee (BHLB Trustee Berhad) for the performance of the contract. Thus the question of refund will not arise.

   
 
   
 

Q10 : If the Purchaser wants to sell the products (e.g. Burial Plot/Cinerary Urn Compartment/Pre-need FSP) he/she purchased, can the Company help the Purchaser to sell the said product?

 

A10 : Our Company does not provide such service as we do not conduct any secondary sales.
